KIng Edward Grammar Schools Admissions Code Non-Compliant

The King Edward Grammar Schools in Birmingham and Rugby High School in Warks, have be had their admisisons policy for 2015 deemed non-compliant.

They attempted to give pupil premium children priority in admissions at a lower score than other children.

An objection was raised and upheld as the schools had not bothered to ensure their funding arrangements allowed it. The fairness was not adjudicated as the schools fell at the first hurdle. What poor legal advice these grammar schools must have had!

The Adjudicator's decisions can be downloaded here. The Adjudicator made it clear all the schools fell foul of the admissions code because their funding agreements didn't allow them to prioritise pupils attracting Pupil Premium. The Adjudicator also made it clear that funding agreements at all of the schools had now been amended so they could prioritise Pupil Premium pupils.

So what now? Can the schools ignore they were non-compliant or must they wait until nex year to discriminate againts non-pupil premium children?
